Challenge to Peaceful Assembly and Public Order Act 2024 Raised in Islamabad High Court

The Islamabad High Court (IHC) is currently reviewing a challenge to the newly implemented law that prohibits peaceful assembly without prior permission in the Islamabad Capital Territory (ICT).

During the proceedings, Chief Justice Aamir Farooq addressed the petitioner’s arguments, which emphasized that the right to peaceful protest is a fundamental right that cannot be outright banned. He noted that while assembly often requires permission in many countries, including those in Europe and the UK, it remains an essential freedom.

The petition also highlighted that violations of this law could lead to a penalty of up to three years in prison, a point that raised concerns about potential infringements on fundamental rights. Chief Justice Farooq indicated that such a severe punishment could indeed conflict with the principles of basic freedoms.

The IHC has adjourned the hearing for two weeks, issuing notices to the federation and the law secretary while summoning Attorney General Mansoor Usman for further clarification.
